(a) use our sites in any way or take any action that causes, or may cause, damage to the sites or impairment of the performance, availability or accessibility of the sites;
(b) use our sites in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;

4.3 You must ensure that all information you supply to us through our sites, or in relation to our sites, is true, accurate, current, complete and not misleading.

Registration and accounts

5.1 You may register for an account or membership with our sites by completing the relevant registration or subscription forms made available on our sites (for example via our membership or profile system) and following any verification steps we may require.

5.2 You must not allow any other person to use your account to access the sites.

5.3 You must notify us promptly in writing if you become aware of any unauthorised use of your account or password.

5.4 You must not use any other person’s account to access our sites.

5.5 All member access and use of our publishing, community or subscription features is subject to these terms and conditions and any additional membership or subscription terms we may publish from time to time.

Subscription and membership terms

6.1 These terms and conditions set out the conditions relating to the sale of digital memberships, subscriptions and access rights (including access to member-only content). Any agreement to purchase a membership or subscription with us is between you and AIISIKI Media (“AIISIKI Media”, “we”, “us”).

6.2 Types of memberships and what is included

6.2.1 Our site offers multiple membership or subscription options (including free, monthly, annual, “pay what you can”, and limited-time promotional offers). The specific features, access rights and charges for each membership type will be described on the relevant membership page at the time of purchase.

6.2.2 Each membership or subscription is personal to the subscriber and grants a non-exclusive, non-transferable right of access to designated content and services, in accordance with these terms and conditions. You must not share your login details or membership access with other people.

6.2.3 Where a subscription includes recurring billing (for example monthly or annually), your chosen payment method will be charged automatically at the intervals stated during sign-up, until you cancel in accordance with our cancellation terms or your membership is otherwise terminated.

6.2.4 We reserve full editorial control over our publications, including the right to add, remove or alter content, sections, formats, or access structures (for example, changing which pieces are behind a paywall), and to modify or withdraw membership features where necessary.

6.3 Placing an order and our acceptance

6.3.1 When you place an order for a membership or subscription through our sites, you are making an offer to purchase that membership/access. We are not obliged to accept your order. We will confirm acceptance of your order by email or by providing access to the relevant member area or content.

6.3.2 You are responsible for ensuring that your billing information is accurate and kept up to date. If recurring payments fail, we may suspend or terminate your membership until payment is successfully processed.

6.3.3 We may refuse, cancel or suspend a membership or subscription where we reasonably believe there has been fraud, misuse, breach of these terms, or where required by law.

6.4 Prices and payments

6.4.1 Membership and subscription prices are as stated on our sites or in our communications at the time you place your order. Prices may vary depending on your location and currency and may change from time to time.

6.4.2 While we aim to ensure pricing is accurate, errors can occur. If a pricing error is discovered in relation to your order, we will inform you as soon as reasonably possible. You will be given the option to reconfirm your order at the correct price or cancel your order and receive a refund of any amounts already paid.

6.4.3 Payments may be processed through third-party payment providers. You may be subject to additional terms and fees imposed by such providers, for which we are not responsible.

6.5 Cancellations and renewals

6.5.1 You may cancel a recurring subscription via your account settings or by contacting us via amms@aiisikimedia.com in accordance with any cancellation instructions provided on our sites. Cancellation will generally take effect at the end of the current billing period, and you will retain access until that date.

6.5.2 Where applicable under local consumer law, you may have a statutory “cooling-off” period. Any such rights will be exercised in accordance with applicable law and may be limited or waived where you have expressly requested immediate access to digital content.

6.5.3 We reserve the right to make changes to membership tiers, pricing and benefits at any time, but we will aim to give reasonable notice of any material changes.

User IDs and passwords

7.1 If you register for an account with our sites, you will be asked to choose a user ID and password or be assigned credentials.

7.2 Your user ID must not be misleading and must comply with any content rules we publish; you must not use your account or user ID for or in connection with the impersonation of any person or entity.

7.3 You must keep your password confidential and secure.

7.4 You must notify us promptly if you become aware of any disclosure of your password or unauthorised access to your account.

7.5 You are responsible for any activity on our sites arising out of any failure to keep your password confidential, and you may be held liable for any losses arising out of such a failure.

User content and submissions

8.1 In these terms and conditions, “your content” means all works and materials (including without limitation text, artwork, photography, audio, video, scripts, reviews, comments and other content) that you submit to us or our sites for publication, consideration, or any other purpose.

8.2 By submitting any content to us (whether via submission portals, email, forms, or other means), you warrant that:

(a) the work is your own original work or you have all necessary rights and permissions to submit it;
(b) the content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights;

(c) the content is not defamatory, discriminatory, hateful, abusive, obscene, or otherwise unlawful; and
(d) the content has not been previously assigned or licensed in a manner that would prevent you granting the rights set out below.

8.3 Unless otherwise agreed in a separate written contract, by submitting content to us you grant to us a non-exclusive, worldwide, royalty-free licence to:

(a) publish, reproduce, store and distribute your content on our sites and associated channels (including newsletters and promotional materials);
(b) make your content available to our members and readers, including behind any paywall or membership restriction we operate;
(c) edit or adapt your content for editorial, formatting or house-style purposes, while respecting its substance; and
(d) use your name, pen name, or chosen credit line in connection with the publication and promotion of your content.

You retain ownership of your work unless a different arrangement is expressly agreed.

8.4 We may, but are not obliged to, review, edit or remove any content submitted by you if we consider it to be inappropriate, unlawful, in breach of these terms, or otherwise unsuitable for our sites.

8.5 We do not undertake to publish or respond to all submissions. Submission does not guarantee acceptance or publication.

Prohibited activities

9.1 Without prejudice to Clause 4 (Acceptable use), you agree that you will not:

(a) use our services to advertise or offer to sell or buy any goods or services, except where we expressly permit this (for example, in a dedicated marketplace or classified section, if provided);
(b) sell, transfer, or otherwise trade your user profile, membership or access credentials;

(c) use our sites to harass, abuse or harm other users, contributors, or staff;

(d) submit content that is knowingly false or misleading, including fabricated personal stories or deliberate misinformation presented as fact;
(e) engage in plagiarism, unauthorised appropriation of others’ work, or submission of AI-generated content as wholly original human-authored work where such use is prohibited by our submission guidelines;

(f) use the sites to conduct or promote any form of hate speech, extremist ideology, or targeted harassment;
(g) interfere with or attempt to interfere with the proper working of our sites, including attempting to bypass access controls or payment systems; or

(h) use our sites primarily as a file-hosting service or to distribute large volumes of unrelated commercial or promotional material.

Limited warranties

10.1 We do not warrant or represent:

(a) the completeness or accuracy of the information published on our sites;
(b) that the material on the sites is up to date; or
(c) that the sites or any service on the sites will remain available, uninterrupted or error-free.

10.2 We reserve the right to discontinue or alter any or all of our sites’ services, and to stop publishing our sites, at any time at our sole discretion without notice or explanation. Except as expressly provided in these terms or required by law, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any services, or if we stop publishing the sites.

10.3 To the maximum extent permitted by applicable law, we exclude all representations and warranties relating to the subject matter of these terms and conditions, our sites and the use of our sites, other than those expressly set out in these terms and required by law.

Limitations and exclusions of liability

11.1 Nothing in these terms and conditions will:

(a) limit or exclude any liability for death or personal injury resulting from negligence;

(b) limit or exclude any liability for fraud or fraudulent misrepresentation;
(c) limit any liabilities in any way that is not permitted under applicable law; or
(d) exclude any liabilities that may not be excluded under applicable law.

11.2 The limitations and exclusions of liability set out in this Clause 11 and elsewhere in these terms:

(a) are subject to Clause 11.1; and
(b) govern all liabilities arising under or in relation to these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise.

11.3 To the extent that our sites and the information and services on our sites are provided free of charge, we will not be liable for any loss or damage of any nature.

11.4 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

11.5 We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, anticipated savings, business, contracts, commercial opportunities or goodwill.

11.6 We will not be liable to you in respect of any loss or corruption of any data, database or software.

11.7 We will not be liable to you in respect of any special, indirect or consequential loss or damage.

Breaches of these terms and conditions

12.1 Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have done so, we may:

(a) send you one or more formal warnings;
(b) temporarily suspend your access to our sites or services;
(c) permanently prohibit you from accessing our sites;
(d) block devices using your IP address from accessing our sites;
(e) contact your internet service provider and request that they block your access to our sites;
(f) cancel your membership or subscription without refund where permitted by law; and/or

(g) commence legal action against you.

12.2 Where we suspend or prohibit or block your access to our sites or a part of our sites, you must not attempt to circumvent such suspension, prohibition or blocking (including by creating or using a different account).

Variation

13.1 We may revise these terms and conditions from time to time.

13.2 We will notify users of any material revision of these terms and conditions (for example by email or site notice), and the revised terms and conditions will apply to the use of our sites from the date specified in the notice. If you do not agree to the revised terms and conditions, you must stop using our sites.

13.3 Where you have an active membership or subscription, we may ask you to expressly agree to any revised terms. If you do not agree within the period we specify, we may suspend or terminate your account and/or subscription, subject to any refund or notice rights required by law.

Assignment

14.1 You may not assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions without our prior written consent.

14.2 We may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions without notifying you or obtaining your consent, provided this does not reduce your statutory rights.

Severability

15.1 If any provision of these terms and conditions is determined by a court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.

15.2 If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed deleted, and the rest of the provision will continue in effect.

Third-party rights

16.1 A contract under these terms and conditions is for our benefit and your benefit and is not intended to benefit or be enforceable by any third party.

16.2 The exercise of the parties’ rights under a contract under these terms and conditions is not subject to the consent of any third party.

Entire agreement

17.1 Subject to Clause 11.1, these terms and conditions, together with our Privacy Policy, Cookies Policy and any additional membership or submission terms, constitute the entire agreement between you and us in relation to your use of our sites and supersede all previous agreements in respect of your use of our sites.
